Definitions

Child - means the person who has registered for and attends the sessions and who’s details are stored in the booking system

Member - means the child who is registered on the system who's membership fee has been paid

Grown Up - means the parent or legal guardian who entered their details on the registration form, pays the membership and session fees and also the parent or legal guardian who attends the sessions with the child

TTKR - means Try Time Kids' Rugby Ltd, the company who you have entered this agreement with. It also includes the Club Owners / Franchisees who run their own clubs and who are trained to deliver the TTKR sessions

Sessions - means the sessions that the Grown ups have signed up to for their child

Term - means the group of sessions that the member must pay for in bulk

Registration System - means the online booking form that either the Grown Up completes or someone from TTKR completes on their behalf to register their child's place on the sessions

Membership Fee - means the one off payment to register the child with TTKR in return for a space in the sessions and branded merchandise

Session Fee - means the cost per session as specified on the booking system

Club Owner - means the Franchisee who has been trained by TTKR to run a Try Time club within their own exclusive territory

Coach - means the person employed or engaged by the Club Owners to support them in delivering the sessions

Park - means the green space in which the sessions are held

Terms - means the terms and conditions set out in this document and on the odd occasion, any additional or special terms and conditions agreed in writing by TTKR and the Grown up
 

These terms and conditions, as may be amended from time to time, apply to all our services made available online, through any mobile device, by email or by telephone. By accessing, browsing and using our website and/or by completing a reservation, you acknowledge and agree to have read, understood and agreed to the terms and conditions set out below.

 

Supervision

Grown ups must remain at the park throughout the entire session and remain responsible for the supervision and safety of their child at all times. Grown ups will indemnify TTKR and/or the Club Owner in respect of any claim brought against them by any third party in relation to their child.

TTKR is not responsible for the safety of children although all reasonable and practicable steps are taken to ensure their safety.

 

Term Dates

Club Owners will normally follow the school term times and therefore consist of a Spring, Summer and Autumn term that will vary in length according to the school term, which will generally mean there will be 39 sessions over the year split across these 3 terms. Club Owners may decide to continue throughout the year and not take breaks. Check the timings with each club before booking.

Term dates and the weeks that sessions are running will be on the web page for the specific clubs. The dates for the following term will either be on the club page as well or can be requested by emailing danielled@trytimekidsrugby.com

 

Fee, Payment and Refunds

The Grown up shall pay the term fees and the membership to TTKR prior to the child commencing the sessions, other than any agreed trial. 

Members may join at any time during the term providing there is space in the session and fees will be adjusted according to the amount of sessions left in the term. All sessions in the remaining term must be booked and paid for in advance.

Book With Confidence: Committing to new activities with toddlers can be daunting (they often change their minds!). So if that happens in your first term with us, you can either pause or get a refund for the remaining sessions of the term. Just let us know!

No money for membership or session fees is to be paid at the sessions directly to the Club Owners or their coaches.

The session fees are not refundable after 7 days.

 

Sibling Discounts

Each club has the right to decide whether to offer sibling discounts. If they do, then the recommendation is 10% for both siblings as long as they are booked into sessions at the same time - they can attend different sessions but they must book at the same time. If one sibling is already a member when the second sibling joins, the discount is only applied to one sibling for that term but the following term, the discount applies to both siblings.

 

Session Cancellations

Occasionally we are asked to cancel a session by the council when ground conditions are being damaged. In the event of this or any adverse weather conditions that may affect the safety of the members or any other Force Majeure, TTKR have the right to cancel a session and the fees are not refundable in any circumstances whatsoever other than with the written consent of TTKR. In the event of cancelled sessions, make up sessions or alternative locations will be offered where possible.

 

Membership Contracts

TTKR may ask a member to stop attending the sessions if they feel their or their grown ups behaviour is damaging the TTKR brand or it is considered dangerous to other children and coaches. TTKR shall not be responsible for any loss or damage whatsoever arising from such cancellation but will refund fees paid for the remaining sessions in the term.

Membership fees are non refundable. TTKR will not refund for any historical sessions whether attended by the child or not.

 

Duty of Care

Whilst the children are not to be left at a Try Time session without a responsible grown up, TTKR still have a duty of care to maintain the safety of the children coming to the sessions. Every site has had a risk assessment done.

TTKR expect the grown ups attending the sessions to behave in an acceptable manner towards both the children, Club Owners and their coaches. If there is behaviour that is deemed unacceptable by TTKR or the Club owners, TTKR and/or the Club Owners will contact the grown up registered on the booking system either at the session or via email, with a report from the coach at the club in question who witnessed the incident or was involved in the incident with recommended actions from head office. In extreme cases, TTKR may report the grown up to the authorities.

One of TTKR's values is Respect and as such expect coaches, children and grown ups to live up to this value at the sessions.

If a child or grown up is considered too ill or too injured to play safely or they have a contagious illness that may put others at risk, TTKR has the right to ask that child and their grown up to leave the session and shall not be responsible for any loss or damage whatsoever arising from such action and will not refund fees for the sessions that they miss due to the illness or injury.

The Club Owners reserve the right to stop the session part way through if they feel threatened in any way and feel that it is in their own interest and those of the other members and grown ups attending to stop playing. TTKR shall not refund fees under these circumstances.

 

Image Rights

From time to time, a member of the TryTime team or an agent acting on behalf of the TryTime team will take photos and videos of the sessions and the children. Try Time Kids Rugby Ltd has the right to take these photos and use them for marketing and promotional purposes. If you do not wish your child to be included in these photos or videos, you must immediately request your child not be included at the time of the photo or video being taken. We may also occasionally share these images with third parties and/or partners for marketing and promotional purposes.

 

Product Delivery

TTKR aim to deliver all products within and up to 14 days of orders received both online and over the phone. Cancellation of orders must be made within 24hrs of order placement.

 

Change or cancel an order

If you wish to change or cancel an order contact our Customer Service team on 020 8168 6680 any time between 10am and 3pm, Monday- Friday. 

If your products have already been delivered, then you will need to follow TTKR’s returns procedure.

 

Returns procedure

TTKR hope you will be pleased with your purchase. Should you find the product is faulty or you have been sent the wrong item and wish to return any product brought from TTKR, TTKR will be happy to refund or exchange a product, provided it is in fully resalable condition. Returns should be made within a reasonable time (usually 28 days) and in original, undamaged packaging.

If TTKR find that the product has not been returned in fully resalable condition, they reserve the right to refuse a refund on the item.

 

Returns via Royal Mail

Please post all returns to the TTKR Head Office address at: TTKR Ltd, Hillview, Sandy Lane, Rushmoor, Farnham, Surrey, GU10 2EU. Please include: Reason for the return and whether you want a refund or a replacement and what size.

Please note: TTKR will refund the price of the item to the purchaser or exchange the product once it is received at Head Office. A refund of the delivery charge will be given in the instance of incorrect, damaged or faulty goods.

 

Delivery charges

TTKR will refund your original delivery charge when a product is faulty or damaged, but not when a product is simply unwanted.

 

Exclusion of Liability

Except in the case of fraud and subject to this clause, TTKR, the Club Owners and their coaches accept no responsibility under any circumstances for any loss (consequential or otherwise), damage, expense or delay suffered or incurred by the Grown up, the child or any other party arising directly or indirectly or in any way connected with the attendance of the child at the session (or any part of it) or any other act or omission on the part of TTKR, even if such act or omission is negligent.
 

The Grown up agrees, for and on behalf of the Grown up and the child, that any claim against TTKR, the Club Owners or any coach must be brought within 60 days of the event that gave rise to such claim. Any claim made thereafter shall be time-barred.
 

The Grown up acknowledges, warrants and undertakes, for and on behalf of the Grown up and the child, that the maximum aggregate liability of TTKR to the grown up and/or child under these terms shall not exceed the Fee.
 

All warranties and conditions whether implied by statute or otherwise are excluded from this contract provided that nothing in this contract shall restrict or exclude liability for death or personal injury caused by the negligence of TTKR, it’s Club Owners or their coaches or affects the statutory rights of the Grown up or the child.

 

Confidentiality

By agreeing to these terms and conditions the Grown up agrees not to share any aspect of the TTKR programme with anyone that is involved or operates in a business in the same market as TTKR Ltd.

The Grown up will not replicate or use any TTKR material directly or indirectly for their own use or a third party.

The Grown up agrees not to directly or indirectly be involved in any business which competes with TTKR while the child is paid up for and attending sessions and for 1 year thereafter.

 

Customer Data

TTKR agrees not to sell your data to any third party. Grown up and childs data may be shared with the Club Owner and they may contact Grown ups directly using this data. TTKR may need to pass the information collected at registration and elsewhere to other companies for administrative purposes. TTKR may use third parties to carry out certain activities, such as processing orders, sorting data, monitoring how customers use the Website and issuing e-mails for TTKR. Third parties will not be allowed to use your personal information for their own purposes. 

 

Competitions

If the winner of the competition is not currently a member, they will not be expected to pay for membership during the term they have won. However if they wish to continue for a further term, they will be required to purchase membership. The closing date is stated on each individual prize draw or competition. Only one entry per prize draw/competition, per person. No purchase necessary. Prize draws and competitions are only open to UK residents. The judge's decision is final and no correspondence will be entered into. Winner(s) will be notified by email or telephone or social media within 6 weeks of the closing date. If TTKR cannot contact the winner (via the details provided at the date of entry) within a reasonable period of time or the winner does not return contact within 14 days of notification that they have won the Prize, TTKR reserve the right to re-draw a winner.

Only one voucher or promotion can be redeemed at any one time or within any one term.

 

General

By agreeing to these terms and conditions the Grown up consents that the data provided (non-financial) can be shared within the TTKR group.

The Grown up shall indemnify and keep indemnified TTKR against all loss (including loss of profit), liability, cost and expenses which TTKR may incur directly or indirectly as a consequence of any action or inaction of the Grown up and/or member.

Any notices to be sent by either party to the other shall be sent by pre-paid recorded delivery or hand delivered to the address of the relevant party and shall be deemed to have been received by the addressee within 48 hours of posting or immediately if hand delivered.

The failure by either party to enforce at any time or for any period any one or more of the obligations arising under this contract shall not be a waiver of them or of the right at any time subsequently to enforce any or all of such obligations.

These terms and conditions constitute the entire agreement between the parties hereto and supersedes prior agreements and understandings between the parties.

This contract shall be governed by the laws of England and the parties submit to the exclusive jurisdiction of the English courts.
